Overview

This website is operated by Summit Creative LLC, a Texas limited liability company trading as Sumud Jewelry (“Sumud Jewelry”, “we”, “us”, “our”). Throughout these Terms, “you” means the visitor or customer using our website, services and content (together, the “Services”).

By visiting our site or buying from us, you agree to these Terms, together with our Privacy Policy, Return & Refund Policy and Shipping & Delivery Policy, each incorporated here by reference. If you do not agree, please do not use the Services.

1. Access and Account

To use the Services you may be asked for information such as your email address and billing, payment and shipping details. You confirm that everything you provide is accurate, current and complete, and that you are entitled to provide it. You are responsible for keeping your account credentials confidential and for all activity under your account.

You must be at least the age of majority in your place of residence to purchase from us.

2. Our Products

We try to display our products as accurately as possible, but we cannot guarantee that your screen reproduces colours and finishes exactly. Jewelry is handled and photographed under studio lighting, and small variations between pieces are normal.

Product descriptions and availability may change at any time without notice. We may discontinue a product, or limit the quantity available to any customer, region or jurisdiction, at our discretion.

3. Orders

Placing an order is an offer to buy. We may accept or decline any order at our discretion, and your order is not accepted until we confirm it. We must receive and process payment before an order is accepted.

Please review your order carefully before submitting it, as we are often unable to accommodate changes or cancellations once an order has been accepted. If we decline, change or cancel an order, we will try to reach you using the email address, billing address or phone number you supplied.

4. Prices and Billing

Prices are shown in the currency indicated at checkout and may change at any time before your order is accepted. Prices on this website may differ from those offered elsewhere or by third-party sellers.

From time to time we run promotions that may be governed by their own terms. Where promotion terms conflict with these Terms, the promotion terms prevail for that promotion.

You agree to keep your purchase, payment and account information current and accurate so that we can complete your transactions and contact you when needed.

5. Shipping and Delivery

Shipping arrangements, timeframes and responsibilities are set out in our Shipping & Delivery Policy. Delivery estimates are estimates only and are not guaranteed.

6. Returns and Refunds

Returns, refunds and cancellations are governed by our Return & Refund Policy, which forms part of these Terms.

7. Intellectual Property

All content on the Services — including text, photographs, graphics, logos, designs and the arrangement of the site — belongs to Summit Creative LLC or its licensors and is protected by intellectual property law. You may not copy, reproduce, republish, sell or exploit any part of the Services without our prior written permission.

8. Optional Tools

We may give you access to third-party tools that we neither monitor nor control. Those tools are provided “as is”, without warranty of any kind, and your use of them is entirely at your own risk. Any new feature or tool added to the store is also subject to these Terms.

9. Third-Party Links

The Services may contain links to third-party websites and content that we do not control and are not responsible for. We are not liable for any harm or loss arising from your dealings with third parties. Please review their terms before engaging with them.

10. Our Ecommerce Platform

The Services are hosted by Shopify, which provides the online platform allowing us to sell to you. Information you submit will be transmitted to Shopify and to third parties that may be located outside your country of residence, in order to provide the Services.

11. Privacy

Personal information submitted through the Services is handled in accordance with our Privacy Policy.

12. Feedback and Submissions

If you send us ideas, suggestions, reviews or other material, we may use, edit, copy and publish it without restriction or obligation to you. You confirm that anything you send is your own, does not infringe anyone’s rights, and is not unlawful, abusive, defamatory or obscene. You may not use a false email address or impersonate anyone. You are solely responsible for what you submit, and we accept no liability for it.

13. Errors, Inaccuracies and Omissions

Occasionally the Services may contain typographical errors or inaccuracies relating to descriptions, pricing, promotions, shipping times or availability. We may correct any such error and may change or cancel an order placed on incorrect information, including after you have submitted it. We are under no obligation to update information except as required by law.

14. Prohibited Uses

You may not use the Services for any unlawful purpose, to infringe anyone’s rights, to harass or abuse others, to submit false information, to upload malicious code, to scrape or harvest data, to interfere with security features, or to compete with or impersonate us.

15. Automated Agents

If you use an automated tool or agent to interact with the Services on your behalf, you remain responsible for everything it does, including every order it places, and these Terms apply to that activity as though you had carried it out yourself.

16. Termination

We may terminate or suspend your access to the Services at any time, without notice, if you breach these Terms. Obligations incurred before termination survive it.

17. Disclaimer of Warranties

Except where expressly stated by us, the Services and all products offered through them are provided “as is” and “as available”, without representation, warranty or condition of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure or error-free. Some jurisdictions do not allow such exclusions, so parts of this section may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, Summit Creative LLC, its members, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits or lost data, arising from your use of the Services or any product bought through them. Where liability cannot be excluded, it is limited to the amount you paid for the order concerned.

19. Indemnification

You agree to indemnify and hold harmless Summit Creative LLC and its members, employees, agents and suppliers against any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party right.

20. Severability

If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and severed from the remainder, which continues in full force.

21. Waiver and Entire Agreement

Our failure to enforce any right or provision does not waive it. These Terms, together with the policies published on this site, constitute the entire agreement between us and supersede any prior agreement or communication.

22. Assignment

You may not assign or transfer your rights under these Terms. We may assign ours without restriction.

23. Governing Law

These Terms are governed by the laws of the State of Texas and the federal laws of the United States, without regard to conflict-of-law rules. You and Summit Creative LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in Bell County, Texas.

24. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page. Your continued use of the Services after a change constitutes acceptance of it. Please review this page periodically.
